This Privacy Policy applies to the services offered on the hoyts.co.nz website operated by The Hoyts Corporation Pty Ltd; ABN 31 006 082 551. Please read this Privacy Policy carefully before using the Hoyts site. Usage of the Hoyts website is conditional upon you agreeing to be bound by this privacy policy.
1. Your personal information is important to us
Hoyts respects the importance of your privacy, and that you have a right to make your own choices about how your personal information is collected and used. We know that when you provide personal information to us you are showing your trust and we take that seriously. Unless you directly give us consent to do otherwise, Hoyts will only collect and use your personal information as we explain below.
2. Collecting information about you
Except as stated in below, Hoyts will not collect or monitor any personal information about you without your consent:
we collect information when you enter your personal information on our site, for example by joining the Cmovies Club or taking part in a competition, when we ask for information such as your email address, name, address, date of birth and what movies you like the most;
if you register on the site, we may also collect information on how you use the site in order to make it as interesting as possible for you; and
if you contact us, we may also keep a record of that contact.
We will only collect additional personal information, other than that explained here, with your consent.
3. Our use of cookie
Cookies are pieces of information that a website transfers to your computer's hard disk for record keeping purposes. Most web browsers are set to accept cookies. Hoyts uses cookies to make your use of our website and services as convenient as possible, such as by customising your web browser's access so that if you are a Cmovies Club Member, you can instantly see the current showings at your favourite Hoyts cinemas when you visit our site. Cookies also enable us to offer products and services that can be bought on line.
If you do not wish to receive any cookies you may set your browser to refuse cookies. However, this will mean you will not be able to take full advantage of Hoyts' services. For example, we will not be able to personalise your website each time you visit.
4. Using and disclosing your personal information.
Our purpose in collecting information about you is to:
provide you with information which interests you and provide you with a better website experience with information and special offers that are more relevant to your interests.
Hoyts will not use or disclose any information about you without your express consent, unless:

we believe it necessary to fulfil the above purposes or otherwise to provide you with a service which you have requested to implement our terms and conditions already agreed to by you
to protect the rights, property or personal safety of another Hoyts user, any member of the public or Hoyts, but in any event in accordance with applicable privacy legislation and principles
In seeking to give you the most worthwhile experience of our website possible, Hoyts may use your personal information to send you advertisements about products and services which we think you are likely to be interested in. We do not disclose information about you to advertisers. Instead, advertisers give us advertisements and tell us the kind of audience they wish to reach. Hoyts then takes the advertisement and displays it to users who are most likely to have an interest in the product or service.
In order to operate the website, fulfil the purposes set out above or otherwise deliver a service we may sometimes share your personal information with a service partner (such as Softcom, which operates our database) or a company connected with Hoyts (by, for example, a common shareholder or some common commercial interest). We will not otherwise disclose your personal information to other companies without your explicit consent.
5. When we will contact you
We will not send you any e-mail without first asking you whether you wish to have promotional information sent to you. If you agree, we may contact you at the email or other address which you provide to us in order to:
Provide you with updated information about our website
Provide you with other information about our products and services which you may enjoy
If you are receiving promotional information about Hoyts and do not wish to receive this information any longer, you may remove your name from our list either by visiting our website and following the instructions on how to withdraw your information from that site (where that facility is available), or e-mailing us at privacy@hoyts.co.nz and asking to be removed from our mailing list. Please allow 14 days for this request to be processed.
6. You can access the information we keep about you
If at any time you want to know exactly what personal information we hold about you, you are welcome to access your record by visiting your Cmovies registration page on our website, or by e-mailing us at privacy@hoyts.co.nz. Our file of your information will be made available to you within 14 days.
7. Changing the information we have about you
If at any time you wish to change personal information that is inaccurate or out of date, please contact us by changing your registration information for the Cmovies club on the site, or by e-mailing us at privacy@hoyts.co.nz and we will amend this record.
8. Deleting the information we have about you or stopping any further advertising material
If you wish to have your personal information deleted, please let us know by changing your registration information for the Cmovies club on the site, or by e-mailing us at privacy@hoyts.co.nz and we will take all reasonable steps to delete it unless we need to keep it for legal reasons. If you do not wish to receive further advertising information from us, please let us know by e-mail or by clicking "No" where you are given the option of receiving future newsletters at the bottom of the MovieMail online newsletter.
9. Competitions
From time to time, Hoyts conducts competitions on the website. When we run these competitions, we may also give you the choice of being on a mailing list to receive further contact from us. Unless you choose to receive further communications from Hoyts, the information which we collect from your entry in the competition is not used for any purposes other for the competition.
10. Storage and security of your personal information
At Hoyts, we try to do everything reasonable to keep secure any information which we hold about you, and to keep this information accurate and up to date. Access to this information is restricted within Hoyts to employees who have specific authorisation. We also continually endeavour to improve our security safeguards. Unfortunately, no data transmission over the internet can be guaranteed to be totally secure, so we cannot absolutely promise that the information you provide to us will always be totally secure. Hoyts will not be held responsible for events arising from unauthorised access to your personal information.
Please note also that Hoyts or its service partners may use overseas facilities to process or back up its information. As a result, we may transfer and store your personal information to our overseas facilities. However, this does not change any of our commitments to safeguard your privacy.
11. Hoyts and links to other websites
Hoyts provides links to websites outside of the Hoyts service. These linked sites are not under our control, and we are not responsible for the conduct of companies linked to our website. Before disclosing your personal information on any other website, we advise you to examine the Terms and Conditions of those websites.
12. What to do if you have a problem or question
If Hoyts becomes aware of any ongoing concerns or problems with on our website, we will take these issues seriously and work to address these concerns.
